Attorney Seeking Plea Agreement In TB Patient Case

A Champaign tuberculosis patient is due back in court later this month in connection with a contempt charge.  Authorities say they're trying to seek a compromise in the case of Christian Mbemba Ibanda.

Ibanda, 24, was released from the Piatt County Jail on Thursday after health officials said he was no longer considered a health risk to others.

Ibanda was arrested last month after the Champaign-Urbana Public Health District said he avoided orders to remain isolated.   Ibanda was jailed in Piatt County because Champaign County doesn't have a negative pressure room that kept him from sharing air with others. 

Champaign County Assistant State's Attorney David DeThorne said a petition of indirect criminal contempt has been filed, and prosecutors are seeking a sentence of no more than 180 days in jail and a $500 fine.

"We're hoping to work things out," DeThorne said.  An order of isolation was terminated.

Ibanda is due back in court for a status hearing on May 23.
