A judge has dismissed criminal charges against Jack McCullough, but is making no immediate decision on a request to appoint a special prosecutor in the case of the 76-year-old man who a state's attorney says was wrongly convicted in a 1957 killing.  

A judge has ordered the release of a 76-year-old Jack McCullough, who a prosecutor says was wrongly convicted of killing an Illinois schoolgirl in 1957.  A prosecutor re-examined evidence and concluded the former Washington state security guard couldn't have committed the crime.

Jack McCullough will get a new attorney to help him pursue freedom from his conviction of murdering seven-year-old Maria Ridulph in 1957.  Last week, the DeKalb County State's Attorney said a six-month review turned up serious missteps during the investigation.
